1. Acceptance of Terms

By using Koby, a product of Luar AI, you agree to these Terms of Service. "Koby" means the Koby website and apps, together with the official Koby browser extension. If you don't agree, please don't use the service.

2. Eligibility

• You must be at least 13 years old to use Koby
• If under 18, you must have parental consent
• You must comply with all applicable laws

3. Account Responsibilities

• Accurate Information: Provide truthful information
• Security: Keep your account credentials secure
• One Account: Don't create multiple accounts to abuse features
• Prohibited Use: No spam, harassment, illegal content, or malicious activity

4. Intellectual Property

• Your Content: You own your highlights, annotations, and data
• Our Platform: Koby's code, design, and branding are owned by us
• License: By using public features, you grant us a license to display your content as necessary to provide the service
• Book Content: Highlights from copyrighted books are subject to fair use; don't share entire books
• Saved Content: Koby's import features and browser extension store copies of content (such as web articles) at your direction, in your private library, so you can listen later to material you had the right to access when you saved it. You are responsible for ensuring you have lawful access to what you save, and you may not use Koby to redistribute copyrighted content or to circumvent any technical protection measure.

5. Subscriptions, Billing & Free Trials (Koby Pro)

Koby Pro is an optional paid subscription. Payments are processed by Stripe. By subscribing, you agree to the following:

• Plans & pricing: Pro is offered as a monthly plan ($10 USD/month) or an annual plan ($96 USD/year). Prices are shown at checkout and may change with notice for future billing periods.
• Free trial: First-time subscribers may be offered a 7-day free trial. We collect your payment method at sign-up, but you are not charged during the trial.
• Auto-renewal: Unless you cancel before the trial ends (or before a renewal date), your subscription automatically converts to a paid plan and renews at the price above (each month for monthly plans, each year for annual plans) until you cancel.
• Cancel anytime: You can cancel at any time from the "Manage subscription" option in the app, which opens the Stripe customer portal. When you cancel, Pro remains active until the end of the period you've already paid for; it is not renewed after that.
• Refunds: Except where required by law, payments are non-refundable, and canceling stops future charges rather than refunding the current period.

6. Service Availability

• We strive for 99.9% uptime but don't guarantee uninterrupted service
• We may modify or discontinue features with notice
• Offline mode works independently of our servers

6.1 Limitation of Liability

Koby is provided "as is" without warranties. We are not liable for:

• Data loss (though we make best efforts to prevent it)
• Indirect or consequential damages
• Third-party services (Firebase, APIs)

Recommendation: Always keep backups of your Kobo database file.

6.2 Termination

We may suspend or terminate accounts that violate these terms. You can delete your account anytime.

6.3 Changes to Terms

We may update these terms with 30 days notice. Continued use after changes constitutes acceptance.

6.4 Governing Law

Koby is operated by Luar AI, currently based in Colombia. These terms are governed by the laws of the Republic of Colombia, and disputes will be resolved in the competent courts of Colombia. If the entity operating Koby changes (for example, to a company established in another jurisdiction), we will update this section and notify users as described in §6.3.

7. Copyright Complaints

Koby respects copyright. Content in a user's library is stored privately at that user's direction (see §4), but if you believe material stored or shared through Koby infringes your copyright, tell us and we will act on it.

• How to notify us: Email luaraiteam@gmail.com with (a) the location of the material on Koby (e.g. a share link), (b) identification of the copyrighted work, (c) your contact details, and (d) a good-faith statement that the use is unauthorized.
• What we do: We review notices promptly and remove or disable access to infringing material.
• Repeat infringers: We terminate the accounts of users who repeatedly infringe copyright.
• Counter-notice: If your content was removed and you believe the removal was mistaken, contact us at the same address.
